Statement of the Ministry of Education and Science of Georgia

An amendment was made to Order No. 120/n of the Minister of Education and Science of Georgia dated December 10, 2010, "On the Approval of the National Qualifications Framework," by Order No. 219/n dated October 8, 2012. On the basis of this amendment, paragraph 5 of Article 4 of Annex Three was worded as follows: "A regulated educational program is focused on preparing the student for the respective regulated profession. To obtain the qualification of a regulated educational program, at least 75% of the mandatory credits established by law must be allocated to the development of competencies essential for the regulated profession." The higher education institution is obliged to reflect this provision in the description of the educational program implemented after the enactment of the said amendment.
According to paragraph 1 of Article 24 of the Law of Georgia "On Normative Acts," a normative act has retroactive effect only if it is explicitly established by this normative act. Order No. 219/n of the Minister of Education and Science of Georgia dated October 8, 2012, "On Introducing an Amendment to Order No. 120/n of the Minister of Education and Science of Georgia Dated December 10, 2010, 'On the Approval of the National Qualifications Framework,'" does not provide for granting retroactive effect to the said normative act. Consequently, the awarding of the respective qualification to persons enrolled prior to the enactment of the order must be based on the educational program that was implemented at the time of their enrollment in the higher education institution.
